What is Separate Maintenance?
Nevada law allows for an ex-spouse to continue to be supported by the other spouse after divorce. This is called alimony, separate maintenance, or spousal support. Either husband or wife can be required to financially support the other, depending upon the financial circumstances surrounding the divorce. The amount of maintenance is based upon several different factors, including:
- Duration of the marriage
- Financial resources of each person
- Physical and emotional condition of each spouse
- Age
- Standard of living during the marriage
What is the Law in Nevada?
Spousal support may be awarded during a divorce action - “temporary maintenance” per NRS 125.040 - or after a divorce: “permanent alimony” meaning there is no end date or ending event, “temporary alimony” meaning there is an end (via date or event), or “rehabilitative alimony” per NRS 125.150 which is used to allow a spouse to get back on their feet.
Separate Maintenance may also be modified: NRS 125.150(7), reflects that prior to the expiration of separate maintenance, either party may file a motion to modify if they can show a change of circumstances.
