What is Paternity?
Paternity means fatherhood. To establish paternity means to create a “legal” father.
Why is it important to establish paternity?
It is important to establish paternity because both parents should have the right to have a relationship with the child. There is a sense of belonging and identity that comes from knowing both parents.
The law requires both parents to support their child even when the parents are not married and the pregnancy is not planned.
It is also important to establish paternity to get a more accurate medical history for the wellbeing of the child.
How can paternity be established?
If the mother of the baby is married when the baby is born, her husband is considered to be the father unless there is an order to say otherwise.
If the mother has been divorced or widowed for less than ten months, her husband at the time of conception is, by law, considered to be the father.
If the mother is married at the time of conception but her husband is not the biological father both parents can sign a voluntary acknowledgment or a judge can declare a man the legal father.
How is paternity testing done?
The mother, child, and father all get a “buckle swab” rubbed against the inside of their cheeks. A laboratory compares different details of the genetic makeup of the mother and child’s with the alleged father’s.
Is Genetic Testing Accurate?
Yes, genetic testing is very accurate. Genetic testing can determine if the man is or is not the father.
What do I do after paternity is established?
After paternity is established an affidavit must be filed with the state. This does not resolve or include matters of custody and visitation. Separate orders will need to be obtained for those.
How is child support determined?
Child support is calculated by a formula set by the state of Nevada.
