What is an Affidavit of Service?

Service means notifying someone that there is a case involving them at Court. An Affidavit of Service is a document that reflects that someone was served. It is filed with the court and shows that a person was served and notified about a case or a part of a case.

The Affidavit of Service is evidence proving to the court that a neutral third party has served/delivered a document to the stated party at a specified date and time.

Does an Affidavit need to be Notarized?

Yes, the affidavit needs to be notarized by a notary and signed by the Affiant (who is the person making the affidavit).

Who can serve a Document?

The Nevada Rules of Civil Procedure address Affidavits of Service:

NRCP RULE 5. SERVICE AND FILING OF PLEADINGS AND OTHER PAPERS

... (b)(4) Proof of service may be made by certificate of an attorney or of the attorney’s employee, or by written admission, or by affidavit, or other proof satisfactory to the court. Failure to make proof of service shall not affect the validity of service.
