What is Adoption?
Adoption is the process by which a person(s) legally assumes the role of parent(s) over another person. An adoption would
grant the petitioners all of the rights and duties of the biological parents. Adoption is intended to be permanent.
What are the Requirements for
Adoption in Nevada?
The Nevada Revised Statutes (Chapter 127) reflect, in part, that:
- Any adult or two spouses if they both consent (if they are at least 10 years older than the adoptee) may ask
the Court to adopt a child. If the child is over 14 years of age then the child must consent. NRS 127.020, NRS
127.030.
- The petitioner must have resided in Nevada for six months prior to the granting of the Petition. NRS 127.060.
- Although there are requirements for consent from the biological/legal parents in NRS 127.040, consent is not
required from a parent whose parental rights have been terminated. NRS 127.090.
What is the Process for Adoption?
Simplified, one files a Petition for Adoption, addresses any responses the biological parents may have, and goes to Court.
Often, the first step is to terminate the parental rights of the biological parent(s).
